Service Terms
Updated
These terms apply when you book a shoot with BuzzAerial, run by Anton Yudin in San Diego, California. By booking a shoot or paying the deposit, you agree to them. “You” means the person who books and the business they book for.
The shoot
Your booking holds the date and time you picked. Please have the property ready and open at that time, with lights on and anything you don’t want filmed put away. If the shoot can’t start because the property isn’t accessible, it counts as a cancellation with less than 48 hours’ notice.
Every flight follows the FAA’s rules for drones. If weather, airspace restrictions or safety stop the flight, I move the shoot to the next time that works for you, at no cost.
Deposit and payment
A $100 deposit holds your day. It counts toward the price of the shoot. The rest is due when your files are delivered.
Moving and cancelling
- 48 hours’ notice or more: move or cancel the shoot at no cost. If you cancel, the deposit is refunded.
- Less than 48 hours’ notice: the deposit is kept.
- If I cancel, or weather or airspace rules stop the flight: you choose a new date or a full refund of the deposit.
You can move or cancel with the link in your confirmation email, or by writing to me.
Delivery
Your photos and video are delivered by a download link, in the time stated for your package. If something in the delivery isn’t what we agreed, tell me within 7 days and I’ll fix it.
Who owns the photos and video
BuzzAerial keeps the copyright in everything filmed and edited for your shoot. You get a license to use it as described below; you do not need to credit BuzzAerial.
How you may use them
You, the property’s seller or owner, and your brokerage may use the photos and video to market that property: on the MLS, websites, listing portals, social media, ads, email and print, during the listing and afterward as a record of the listing. You may trim, crop and add text or music.
Please don’t sell or license them to anyone else, use them to market another property, use them as stock footage, or edit them in a way that misrepresents the property. If you’d like a wider use, ask me and we’ll agree on it in writing.
How BuzzAerial may use them
I may use the photos and video to show my work: on this website, on social media, in ads and in my portfolio. I never show the street address unless the listing is public.
You can say no. Tick “Don’t use this shoot in BuzzAerial’s marketing” when you book, or tell me by email before the shoot, and I won’t use it. If you change your mind later, tell me and I’ll take it off my website and social media within 14 days. Ads that have already run can’t be taken back.
The owner’s permission
By booking, you confirm that the property’s owner, or whoever controls it, has agreed to the shoot inside and outside, and to the uses above, and that anyone living there knows it will happen. I avoid filming people, and I leave out anyone who asks not to be filmed.
Responsibility
I carry drone liability insurance. If anything at the property is damaged during the shoot, tell me within 48 hours so it can be handled. Apart from damage I cause, BuzzAerial’s responsibility for a shoot is limited to the amount you paid for it, and neither of us is responsible to the other for indirect losses, such as a lost sale.
Changes and law
If these terms change, this page changes and the date at the top moves. A shoot keeps the terms that applied when it was booked. These terms are governed by the laws of California, and any dispute is decided in San Diego County.
